A woman has been jailed after she bashed another woman for making anti-Semitic remarks who later died in hospital.
Sarah Murphy, 51, and Sarah Franklin clashed in a two-minute-long attack near the coffee station at a 7-Eleven service station in Caulfield two years ago.
The pair both entered the store just after 10am on February 8, 2022.
Witnesses later reported hearing Ms Murphy making racist remarks about Jewish people and throwing a sugar packet towards Franklin, who responded by throwing a full cup of coffee at her.
Franklin then attacked Ms Murphy, with the pair tumbling towards the ground as Ms Murphy bit her assailant.
In a recording, Ms Murphy can be heard yelling; “Leave me alone, help, help me … I can’t breath.”
Franklin responded: “Are you calm now?”, as she had her in a headlock.
After Ms Murphy, who was asthmatic and suffered from mental illnesses, fell unconscious, Franklin left the store.
She had stopped breathing but was revived by paramedics before being taken to The Alfred hospital.
Ms Murphy suffered a major stroke and died six days later.
Franklin was initially charged with manslaughter, however this was dropped after forensic experts couldn’t identify Ms Murphy’s cause of death.
Prosecutors accepted she had been acting in self-defence up until the moment she kept Ms Murphy in a headlock after she’d made it clear she couldn’t breath.
Previously a court was told, her death could have been caused by a number of factors, including health conditions and drug toxicity.
Franklin, 53, returned before the Moorabbin Magistrates’ Court on Wednesday after pleading guilty to a common assault charge late last year.
The court was told she’d written a letter saying she was “deeply regretful” for the assault.
She was jailed for four months by Magistrate Stephen Lee.
Just before she was taken into custody, her lawyer, Greer Boe, flagged they intend to appeal the sentence in a higher court.
An hour later Franklin was granted bail ahead of her appeal hearing on June 5.
